These Terms & Conditions ("Terms") govern your access to and use of the Pulmona application, website, software, features, content, and related services (collectively, the "Service"). Pulmona is operated by CIBELE, Inc., a Delaware corporation ("CIBELE," "Pulmona," "we," "us," or "our"). By accessing or using Pulmona, you acknowledge that you have read, understood, and agreed to these Terms and the other applicable legal policies governing the Service. The visual lungs displayed in the application are an illustrative animation intended to help users follow a breathing rhythm. They do not represent an actual measurement or visualization of the user's lungs.
You must be legally capable of entering into a binding agreement to use Pulmona.
If you are below the age at which you can independently consent to digital services in your jurisdiction, you may use Pulmona only with the involvement or consent of a parent or legal guardian where required by applicable law.
Pulmona may provide breathing sessions using visual or timed guidance.
Users remain responsible for determining whether a particular breathing exercise is appropriate for them.
You should breathe comfortably and naturally and should not intentionally hold your breath or force your breathing beyond what feels comfortable unless following instructions from an appropriate qualified professional.
If you experience discomfort, dizziness, shortness of breath, chest pain, faintness, or other concerning symptoms while using Pulmona, stop the session and seek appropriate medical assistance when necessary.
Pulmona may display a respiration or breathing-cycle count during or after a session.
This count is based on the application's session mechanics and does not constitute a medical measurement of respiratory rate.
The displayed count may not correspond to an individual's clinically measured respiratory rate.
Pulmona does not guarantee that any displayed count is medically accurate.
The animated lungs are a visual representation designed to provide a calming breathing cue.

You are responsible for using Pulmona in a manner appropriate to your circumstances.
Do not use Pulmona to replace instructions from a physician, therapist, respiratory specialist, or other qualified healthcare professional.
If you have a medical condition or concern relating to breathing, consult an appropriate healthcare professional before engaging in breathing exercises.

Applicable taxes may be added or included depending on your jurisdiction and the payment platform.
Subscriptions may automatically renew at the end of each billing period unless canceled before renewal.
The applicable subscription terms, including price, billing period, renewal, and cancellation information, will be disclosed before purchase.
If Pulmona offers a free trial or promotional offer, the applicable terms will be presented before enrollment.
If a free trial automatically converts into a paid subscription, the user will be informed of the applicable price, billing frequency, renewal terms, and cancellation procedure before subscribing.

Nothing in these Terms limits mandatory consumer rights applicable in your jurisdiction.
Pulmona, including its software, interface, design, branding, logos, animations, visual lung representations, original text, graphics, sounds, and other original materials, is owned by or licensed to CIBELE, Inc.
You may not reproduce, distribute, sell, sublicense, modify, reverse engineer, or commercially exploit the Service except where expressly permitted by applicable law or by CIBELE, Inc.

To the maximum extent permitted by applicable law, CIBELE, Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of Pulmona.
To the maximum extent permitted by applicable law, CIBELE, Inc.'s aggregate liability arising from the Service will not exceed the greater of: (a) the amount paid by the user to Pulmona during the twelve months preceding the event giving rise to the claim; or (b) USD $100.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
To the extent permitted by applicable law, you agree to indemnify and hold harmless CIBELE, Inc. and its officers, directors, employees, contractors, and service providers from claims arising from:

These Terms, together with the Privacy Policy, Refund & Subscription Policy, Cookie Policy, and Wellness & Breathing Disclaimer, constitute the agreement between you and CIBELE, Inc. concerning your use of Pulmona.
